DBA AND HEREINAFTER KNOWN AS MARTY CONNELL PHOTOGRAPHY. UNAUTHORIZED REPRODUCTIONS, SALE OR PUBLICATION OF ANY PART OF THIS WEBSITE BY ANY METHOD WITHOUT EXPRESSED WRITTEN PERMISSION OF MARTY CONNELL PHOTOGRAPHY WILL CONSTITUTE COPYRIGHT INFRINGEMENT AND WILL BE PROSECUTED TO THE FULL EXTENT OF FEDERAL AND INTERNATIONAL COPYRIGHT LAW.

Ownership - This website, webpage, all text and images are owned and operated by Marty Connell Photography. All content images and general design are protected by copyright, trademark and Montana, USA and International laws relating to intellectual property. It is illegal to copy or reproduce any of the images without prior written consent. It is considered a violation of law to use any portion of the images as reference for another photograph, illustration, and derivative work in any form whatsoever.

Limitation of Liability - The limit of liability of the copyright owner, Marty Connell Photography shall be limited to the fee paid for the image. Marty Connell Photography will not be liable for any direct, indirect, consequential, incidental or punitive damages as a result of the use of this site or from your access or use of the images on this site.

Governing Law - This agreement shall be enforced in accordance of the laws of the State of Montana in the event either party resorts to litigation to enforce the terms of this agreement. Venues shall be proper at Billings, Yellowstone County, Montana. Marty Connell Photography shall have the sole right to copyright claims to bring those under Federal Court jurisdiction. User agrees to be subject to the jurisdiction of the Federal Court in the District that Marty Connell Photography resides.

Binding Effect - The obligations that are the responsibilities of the agreement shall be binding upon and rights and benefits shall inure to the heirs, successors, assigns of respective parties, hereto; provided, however, that no obligations shall be assignable. Enforcement In the event Marty Connell Photography undertakes any action to enforce performance under this agreement including but not limited to obligations to make payments that you agree to pay and you shall pay Marty Connell Photography all costs including reasonable attorney fees.

Assignability - This agreement is not assignable or transferable on the part of the user.
